Under Paid Claim LLC is a licensed Texas public insurance adjusting firm. When you contact us about a claim, you hand over information about your property, your policy, and your loss. This page explains what we do with it, in plain English.
What we collect
When you contact us. Your name, business name, phone number, email address, and property address. Whatever you tell us about the loss.
When you engage us on a claim. Your insurance policy and policy number, the carrier's correspondence and estimates, photographs and documentation of the damage, repair invoices and bids, and the settlement amounts paid on the claim. We also collect the signed contract required by Texas law before any work begins.
When you use this website. Standard traffic data — pages visited, referring site, approximate region, browser and device type. This is aggregate analytics. It does not identify you.
We do not collect Social Security numbers, financial account numbers, or payment card numbers through this website. Do not send them through the contact form.
What we use it for
- Reviewing your claim and telling you what we see in it
- Documenting the loss, building the estimate, and presenting the claim to your carrier
- Communicating with you and with the carrier's adjuster on your behalf
- Meeting the record-keeping obligations Texas places on licensed public adjusters
- Understanding which parts of this website people actually use
That is the whole list. We do not use your claim information to market anything to you beyond your own claim.
Who we share it with
Your insurance carrier, once you have authorized us to represent you on the claim. That is the point of the engagement.
Service providers who help us run the business — website hosting, email, estimating software, document storage. They handle your information only to provide that service to us.
An attorney you choose, if you engage one and direct us to share the file. We are not attorneys, we do not provide legal advice, and we do not refer you to one. That choice is yours.
The Texas Department of Insurance, if it requests our records in the course of an examination. State law requires this.
When the law requires it — a subpoena, a court order, or a regulatory demand.
We do not sell your personal information. We do not sell sensitive personal information. We do not trade, rent, or share your claim information with contractors, roofers, restoration companies, lead brokers, or anyone else who might want to sell you something. Under Paid Claim LLC does not perform, supervise, or arrange repair work, and we are not paid by anyone who does.
How long we keep it
Texas law requires a licensed public insurance adjuster to keep complete records of each claim — the contract, the policy and carrier details, an accounting of what was recovered, and what we were paid — for at least five years after the transaction with the insured ends (Tex. Ins. Code §4102.110). We keep claim files for that period at minimum.
If you contacted us but never engaged us, tell us and we will delete your inquiry.
Phone calls and text messages
If you give us your phone number, we may call or text you about your claim or your inquiry. Message and data rates may apply. Reply STOP to any text to stop receiving them. We do not send marketing texts and we do not share your number with anyone who does.
Cookies and analytics
This site uses cookies to keep the site working and to measure traffic in aggregate. You can block or delete cookies in your browser settings; the site will still work. We do not use advertising trackers that follow you to other websites.
How we protect it
Claim files are stored in access-controlled systems, and access is limited to the people working on your claim. No system is perfect, and we won't tell you otherwise — but your claim documentation is our working material, and we treat it the way we would want ours treated.
Your choices
You can ask us to:
- Tell you what information we hold about you
- Correct anything that is wrong
- Delete an inquiry that did not become a claim engagement
- Stop contacting you
Email Claim@UnderPaidClaim.com or call 956-772-4404. We will respond within 45 days. For active claim files, the five-year retention requirement above limits what we can delete.
Texas residents have additional rights under the Texas Data Privacy and Security Act. If you believe we have not handled a request properly, you may appeal by replying to our response, and you may contact the Texas Attorney General's Consumer Protection Division.
Children
This website is for commercial property owners. It is not directed at children, and we do not knowingly collect information from anyone under 18.
Changes to this policy
If we change this policy, we will update the effective date at the top of this page.
